Terms of service

1The agreement
These terms cover your use of JET POS: the software, the terminals, this website, and the support that comes with them. Using any of it means you accept them.
If you have signed a separate written agreement with us, that agreement wins wherever the two disagree. Your card processing is governed by a separate merchant agreement with the processor, which is not this document.
You need to be authorised to enter into contracts on behalf of your business to accept these terms.
2What we provide
Point of sale software and the hardware it runs on, along with the parts listed on this site: kitchen display, self-order kiosk, handheld ordering, reporting, the built-in assistant, and integrated card processing.
We add and change features. We will not remove something you depend on without telling you first. If we retire a feature that is material to how you run your shop, you can cancel without penalty.
Installation, menu build and staff training are included as described on the pricing page.
3Your account and your staff
You are responsible for what happens under your account, including what your staff do with the logins you issue them. Give people the permissions their job needs and take them away when they leave.
Tell us promptly if you think an account has been compromised. Keep your business and contact details current, because they are how we reach you when something is wrong.
4Fees and billing
Software
Plan prices are on the pricing page. Paid plans bill in advance for the period you selected. Fees are not refundable for a period already started, and we will give at least thirty days notice before a price change.
Card processing
Card-present transactions are 2.5% + 10¢. Rates can differ on unusually high volume or an unusual card mix, and where they do, the number is put in writing before you sign. Processing fees are deducted from settlement in the normal way.
Free POS
The $0 plan requires JET card processing on a one year agreement, online ordering switched on, and at least $15,000 per month in card sales. That first year is what pays for the terminal, which is why leaving early carries a fee, prorated against the months remaining. The full conditions are on the Free POS page.
Late payment
If an invoice goes unpaid we will contact you before doing anything else. Persistent non-payment can lead to suspension, and we will tell you before we suspend anything.
5Hardware
Hardware bought outright belongs to you once it is paid for. Hardware provided at no cost under the Free POS plan remains ours until the commitment period is complete.
Equipment carries the manufacturer’s warranty. We will help you use it. Damage from misuse, liquid, drops or power problems is not covered by it.
Where we ship something to you, risk passes on delivery. Shipping timescales we quote are estimates rather than guarantees.
6Acceptable use
Do not use JET to:
- Break the law, or process payments for anything illegal.
- Take payments you are not entitled to take, or run transactions you know are fraudulent.
- Attack, probe or attempt to gain unauthorised access to the service or to other customers.
- Resell or sublicense the software without a written agreement with us.
- Reverse engineer it, except where the law says you may.
Age-restricted goods are your responsibility to sell lawfully. The product gives you ID scanning and a record of the check; using it is on you.
7Your data
Your business data is yours. We use it to run the service you are paying for, to support you, and to answer the questions you put to the built-in assistant. We do not sell it.
Ask for an export at any time, including when you leave. The privacy policy sets out retention and your rights, and security describes how it is handled.
8Intellectual property
The software, the brand and the site are ours. You get a licence to use them for as long as your account is in good standing, and that licence ends when the account does.
Your menu, your recipes, your photographs and your customer records stay yours. Nothing here gives us a licence to use your brand in our marketing without asking you first.
9Warranties and liability
We provide the service as it is. We do not warrant that it will be uninterrupted or error-free, and no advice we give you creates a warranty that is not written here.
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profit, lost revenue or lost data, and our total liability in any twelve month period is limited to the fees you paid us in that period.
Some jurisdictions do not allow those exclusions. Where that is the case, they apply to the extent permitted and no further. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.
10Ending it
Monthly plans can be cancelled at any time and run to the end of the period you have paid for. Annual billing needs thirty days notice. Free POS carries the one year processing commitment described above.
We can suspend or close an account for non-payment or for a breach of the acceptable use section, and other than in serious cases we will tell you first and give you a chance to fix it.
When an account closes, ask for your export. Hardware we own comes back to us; hardware you own stays with you.
11Governing law and changes
These terms are governed by the laws of the State of Delaware, and disputes go to the courts of Delaware. If a clause is found unenforceable, the rest continues to apply.
When we change these terms the date at the top of the page changes. For a material change we will tell account holders directly. Continuing to use the service after a change means accepting it; if you do not accept it, you can cancel.
